What you will need is ambition, talent and some key skills. For this vital role as Sr. Corporate Counsel, IP & Marketing, the attorney in this position will work with clients across multiple functional areas to strategically protect the company's trademark, copyright and patent interests. Primary responsibilities include providing legal and strategic support and oversight with respect to our global intellectual property portfolio (including trademarks, patents, copyrights and domain names), counseling and advising on primarily trademark and copyright issues and supporting IP litigation, due diligence reviews and IP related transactional work. Additionally, the attorney in this role will provide general commercial legal support to multiple functional areas involving advertising review, contract negotiation and drafting, and hotel operations as well as interfacing with others within legal, risk management, assurance and information security. To globally support creation, protection, enforcement, monetization and knowledge management and overall strategy for IHG's Intellectual Property and support the category brand marketing function
Your day to day
Essential Duties and Responsibilities
Lead and engage with a global virtual team for the management of a large, global trademark portfolio including oversight of domestic and international conflict matters
Review names, designs and marketing materials to ensure compliance with intellectual property and consumer protection laws and regulations.
Oversee trademark clearance and offer recommendations to internal business partners on risk mitigation and potential conflicts; provide thought leadership on global trademark fling and enforcement strategies
Oversee franchise termination de-identification challenges and issue cease & desist letters where warranted
Draft and negotiate sponsorships, marketing agreements, licenses, settlement or coexistence agreements, agency agreements, content development agreements
Proactively identify emerging issues, mitigate risk, and continuously improve processes within compliance standards Use outside counsel and other external resources as appropriate to ensure the Company is represented in a cost efficient and effective manner. Where relevant, develop and/or meet internal and external budgets and track to measure performance.
Develop and maintain a good working relationship in all client areas. Assist management in evaluating the legal impact of various corporate or department strategies, determining alternatives based on business and legal considerations and the relevant environment.
Represent and support department or division management in dealings with external parties.
Coordinate and work with other areas of Business Reputation and Responsibility on related matters to ensure efficient resolution of issues.
Train and educate employees on germane legal matters as preventive legal measures.
What we need from you
Critical Expertise & Experience:
Bachelor's Degree and a Juris Doctor Degree. 10+ years' work experience in the practice of law with in-depth knowledge of global trademark portfolios and portfolio management (i.e., clearance, filing, enforcement, licensing, and counseling contracts and contract negotiation, marketing and consumer protection. Demonstrated proficiency in multiple disciplines/technologies/processes related to the position. Knowledge of international trademark environment, particularly China, important.
Technical Skills and Knowledge:
Demonstrated analytical, research, and presentation skills, with ability to speak extemporaneously. Demonstrated ability to draft a variety of legal documents.
Demonstrated project management experience in organizing, planning and executing large-scale projects from conception through implementation.
Demonstrated experience in leading, advising and developing people.
Demonstrated effective verbal and written communication skills for the purpose of providing information to clients, outside counsel, vendors and other third parties, senior management and staff.
Strong ability to think strategically and globally. Ability to work collaboratively. Understanding of Anaqua database a plus.
